Two foreigners may marry in Romania — several town halls deal explicitly with the case. But the declaration must be filed at the town hall of one spouse’s domicile or residence: a territorial connection is therefore needed, and the file is lodged eleven to thirty days before the ceremony.
- The declaration is filed at the town hall of one intended spouse’s domicile or residence; a waiver is possible with the agreement of the mayor concerned.
- The marriage is held from the eleventh day after filing and no later than the thirtieth, as the civil code provides.
- Passport in original and copy, bearing the entry visa, valid both when filing and on the day of the ceremony; identity card for EU citizens.
- A certificate of capacity to marry issued or authenticated by the diplomatic mission of your country accredited in Romania; some town halls accept a certificate less than three months old from the competent authority, or a notarised declaration.
- A birth certificate, apostilled or fully legalised, translated and certified by a Romanian notary; multilingual extracts need no translation.
- An original pre-nuptial medical certificate, valid thirty days, issued in Romania and expressly stating that you may marry; an authorised translator must attend both the filing and the ceremony.
The catch
Two locks combine. The certificate of capacity to marry must come from your country’s embassy or consulate accredited in Romania, and many missions do not issue it. And the pre-nuptial medical certificate must be obtained locally. So the real calendar is not eleven days but several weeks in Romania.
Same-sex couples
None of the registry sources consulted provides for marriage or registered partnership between people of the same sex; all refer to spouses of different sex. The civil code provision said to prohibit it could not be consulted, so this point is reported as it stands.
