Yes. The gov.pl portal sets no nationality or residence condition and states that the marriage may be held at any registry office in the country. A foreigner must, however, prove they are free to marry under their own national law.
- Each foreigner provides a certificate that they may marry under their national law, a birth certificate, and where relevant proof that an earlier marriage was dissolved.
- Any foreign-language document must be translated by a Polish sworn translator or by a Polish consul.
- At least one month separates the filing of the declaration of intent from the ceremony; the declaration stays valid for six months.
- Two adult witnesses are required, present when the declarations are made.
- Fees: 84 zł for the marriage certificate, a further 1,000 zł for a ceremony away from the registry office, 39 zł to ask for the one-month wait to be shortened.
- If a spouse does not speak Polish, the declarations are made in the presence of a translator.
The catch
Obtaining the certificate of capacity to marry, which several states do not issue. You must then apply to the district court for an exemption, with a consular attestation that none is issued — a procedure the government’s returns portal describes as taking several months.
Same-sex couples
No. The official procedure repeats the family code’s wording: marriage is contracted between a man and a woman, both present. No official source consulted establishes a registered partnership open to same-sex couples.
