Legal marriage possible

Yes. Two foreigners with no residence in Germany may marry there: the competent registry office is then the one where the ceremony will take place. Only the marriage before the registrar has legal effect.

• The marriage is declared at the Standesamt of the place of celebration whenever neither spouse is resident in Germany.
• A certificate of matrimonial capacity (Ehefähigkeitszeugnis) is required in principle. Where a state does not issue one, an exemption must be sought from the president of the court of appeal (Oberlandesgericht).
• Usual documents: photo ID, a recent birth certificate naming the parents, a certified divorce decree if divorced, the spouse’s death certificate if widowed.
• Documents must be produced as originals, apostilled or legalised depending on the country, and translated by a sworn translator. Names in Arabic, Greek, Hebrew or Cyrillic script are transliterated to the ISO standard.
• The declaration stays valid for six months: within that window the marriage may be held at any German Standesamt.
• Fees recorded in Berlin: €45 for the declaration, a further €45 per spouse governed by foreign law, €12 for the certificate. Rates are set locally and vary between Länder.
