Two foreigners may marry, but the capital’s procedure requires proof of declared stay in Montenegro and a certificate of no criminal proceedings less than a month old. So it is not a marry-on-arrival country, despite the reputation of Kotor and Budva.
- Birth certificate and certificate of capacity to marry less than three months old, in original with a court translator’s translation; apostille compulsory for Hague Convention states.
- A certificate that no criminal proceedings are pending in the country of nationality, less than one month old, in original and translated.
- Proof of declared stay in Montenegro for the foreign national.
- A copy of valid ID or passport, and of the witnesses’ identity documents.
- Foreigners provide an attestation that they know the official language, or arrange for an accredited court translator to attend.
- The application is filed at least fifteen days before the ceremony, with a decision within three days; €20 on official premises, €100 elsewhere.
The catch
The combination of proof of declared stay and a certificate of no criminal proceedings less than a month old. The second is the real bottleneck: many administrations take more than a month to issue it, and an expired document must be requested again.
Same-sex couples
Not open to marriage. Since 2020 Montenegro has had a law on life partnership for same-sex couples, and the capital’s procedure handles marriage and partnership in the same instrument.
