The Netherlands opened marriage to same-sex couples before anyone else, in 2001. But it will not marry two foreigners who both live elsewhere: the law asks that one of you be Dutch or resident in the country. Dutch agencies therefore do a great deal of symbolic-ceremony work, with the legal marriage taking place at home.

No legal marriage without residence
No. The government portal states the condition plainly: at least one of you must be Dutch or live in the Netherlands. Two foreigners both living abroad cannot marry there.
- Condition of access: one spouse must hold Dutch nationality or live in the Netherlands. Failing that, marriage there is not possible.
- Where both live abroad and the nationality condition is met, the notice of intent is filed with the municipality of The Hague.
- The national portal gives a minimum of eight weeks before the wedding date. Maastricht adds that the notice may be filed at most a year ahead, and that processing takes at least fourteen days, longer with foreign documents.
- Substantive conditions: both aged eighteen, no prior marriage or registered partnership, and a bar between parents and children, grandparents and grandchildren, siblings.
- Between two and four witnesses, each at least eighteen.
The catch
The condition itself. This is not a paperwork problem but a bar in principle: no Dutch municipality has jurisdiction, and no waiver procedure appears in the official sources consulted. A symbolic ceremony remains possible, with the legal marriage taking place at home.
